Terms of Service

These terms govern your account on this site and your use of the services offered through it. Please read them before you create an account — you are asked to agree to them when you register.

Please read this before you open an account.

These terms are the agreement you accept when you register. They cover who we are, who may open an account, what is offered here and the risk that comes with it, what each of us is responsible for, and what to do if something goes wrong. Ask us about anything you are unsure of before you agree to it.

1. Who these terms are between

These terms are an agreement between you (the person using this site) and the operator of this site ("we", "us"). They apply from the moment you create an account and for as long as you have one.

We are Apexflip Premium. You can write to us at support@coinflipxchange.today, and our postal address is 100 Crypto Lane, Suite 300, San Francisco, CA 94105.

Where the law that applies to us requires us to publish a company registration number, a registered office, or the authority that authorises us together with the reference it issued, we publish them in the legal line at the foot of every page on this site, and they form part of these terms.

We describe ourselves as authorised, licensed or regulated only where that is true and can be evidenced. No statement anywhere on this site should be read as such a claim unless it names the authority that granted the permission and the reference number under which it was granted.

2. Agreeing to these terms

When you register you are asked to confirm that you agree to these terms. We record the moment you agreed and the version of this document you agreed to, so that both of us can tell later exactly what was accepted. The version is shown at the top of this page.

If we change these terms, we publish the updated document with a new version. Continuing to use your account after a change means the current version applies to you.

3. Who can open an account

To open an account you must:

  • be old enough to enter into a binding contract where you live, and in any case at least 18;
  • be acting for yourself and not on behalf of somebody else without telling us;
  • give information that is accurate and keep it up to date; and
  • not be barred from using services of this kind under any law that applies to you.

We cannot accept customers everywhere. Some countries and territories are closed to us — because of sanctions, because the law that applies to us forbids it, or because we are not permitted to offer these services there. Where a country is closed, an application from it is refused, and an account opened from it may be restricted or closed once we find out. If you are unsure whether we can accept you, ask us before you deposit anything.

We may also decline an application, or ask for more information before we accept one, without giving a reason. Nothing on this site is an offer to open an account for you; your registration is an application, and the account exists when we accept it.

4. Your account and your credentials

You choose a password when you register. We never store it in a readable form — it is hashed before it is saved, and it cannot be recovered or read back by anyone, including us. If you forget it you reset it; we cannot tell you what it was.

You are responsible for keeping your password and any second factor to yourself, and for everything done through your account. Tell us straight away if you think somebody else has access to it. Where this site offers email verification or two-factor authentication, we may require you to complete them before parts of your account become available.

5. How you may use this site

You agree not to:

  • use the site for anything unlawful, or to disguise the origin of money;
  • give false information, or use somebody else's identity or payment details;
  • open more than one account without our agreement;
  • interfere with the site, attempt to gain access to parts of it you have not been given, or extract data from it by automated means; or
  • resell or redistribute access to the site or its contents.

6. Suspending or closing an account

We may suspend or close an account where we reasonably believe these terms have been broken, where we are required to by law, or where required information has not been provided. Where we do, we will tell you at the address on your account unless we are prevented from doing so. You may close your account at any time; closing it does not by itself cancel obligations either of us already has.

7. Identity checks

Where this site asks you to verify your identity, you agree to provide the documents requested and confirm they are genuine and yours. We may restrict what your account can do until verification is complete.

We may ask you to confirm who you are, where you live and where your money comes from, and to evidence it — typically with a government-issued photographic identity document, a recent document showing your address, and, where the amount or the payment method calls for it, evidence of the source of the funds. We may use a specialist verification provider to carry the check out for us; where we do, it receives only what the check needs, and the privacy policy says what that is.

You may decline. If you do, or if a check cannot be completed, we may limit what your account can do — refuse a deposit, hold a withdrawal, or close the account and return the balance to the source it came from. Where the law that applies to us requires us to act and to say nothing about why, we will comply with it.

8. What this site offers

This site offers trading in contracts for difference (CFDs) and similar leveraged products over foreign exchange, indices, commodities, shares, ETFs and crypto assets, together with the services around them — funding and withdrawing an account and, where they appear on this site, copy trading, automated strategies and investment plans. You do not buy or own the underlying instrument. You take a position on its price, and the position settles in cash.

These products are leveraged, and that is the whole of the risk. A small move in the underlying price produces a proportionally larger move in your position, in both directions, so you can lose money faster than the market moves and lose more than you meant to put at risk. If the margin on your account falls below the level we require, open positions may be closed automatically, at the price available at that moment and without warning. Most retail investor accounts lose money trading these products.

What your account costs you — the spread on each instrument, any commission, the financing charge for holding a leveraged position overnight, currency conversion, inactivity, and any fee on a deposit or a withdrawal — is published on the pricing and plan pages of this site and shown in your account before you confirm an order. We will tell you before a charge changes. Where a charge is not published in one of those places, it does not apply.

Nothing here is investment advice or a recommendation, and nothing here is a promise about performance. How an instrument, a trader you copy, an automated strategy or a plan has done in the past does not tell you how it will do next. Any figure shown as an illustration is an illustration.

9. Availability

We aim to keep the site available but we do not promise it will be uninterrupted or error-free. Access may be unavailable during maintenance, or because of failures outside our control. We may change, add or withdraw features.

10. Content and ownership

The site, its design and its contents belong to us or to the people we license them from, and you may use them only to use your account. Anything you upload remains yours; you give us permission to store and process it so we can operate your account.

11. Liability

We are responsible to you for loss we cause by failing to provide this service with reasonable care and skill, or by breaking these terms.

We are not responsible for the market. A position you chose to open is yours: losses caused by price movement, by a position being closed on margin, or by a trader, strategy or plan you chose to follow are not losses we caused. Nor are we responsible for loss that was not foreseeable when you accepted these terms, for loss arising from information you gave us that was wrong or out of date, or for interruption caused by something outside our reasonable control — the failure of a network, an exchange, a liquidity provider, a payment provider or a data feed. That last one does not excuse us from putting right afterwards anything we can put right.

We do not limit or exclude any liability that the law applying to you does not permit us to limit or exclude, including liability for death or personal injury caused by our negligence and liability for fraud. Where the law where you live gives you rights as a consumer, nothing in these terms takes them away.

12. Governing law and disputes

If something goes wrong, tell us first. Write to support@coinflipxchange.today setting out what happened, when, and what you would like us to do about it. We will acknowledge it, look into it, and give you a written answer with our reasons. Keep a copy — you will need it if you take the matter further.

This agreement is governed by the law of the country in which we are established — the country of the address given in section 1 — and the courts of that country have jurisdiction over any dispute arising out of it. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of the country where you live, and you may also bring proceedings in the courts there.

Where the country in which we are established provides an ombudsman, a financial-services complaints scheme or a compensation scheme that covers this service, we will tell you how to reach it in the answer we give you, and you may take your complaint there if ours does not satisfy you.

13. Contacting us

Write to support@coinflipxchange.today about anything in this agreement — your account, a charge you do not recognise, a complaint, or a request to close the account. Our postal address and any other channel we answer on are in the footer of every page and on our contact page.

We answer messages in the order they arrive and aim to reply within five working days. A complaint gets a written answer with our reasons; section 12 says how that works.
